I'm pretty sure that it's being used for a breed profile on a BYB site. http://www.gate.net/~luckypup/keeshond.html Do you guys think it's a BYB site? Read their pages that talk about their "puppy store" and facilities and tell me if you agree? http://www.gate.net/~luckypup/puppystore.html http://www.gate.net/~luckypup/facilities.html I'm guessing they swipped it from Dog Breed Info. Center without the webmaster's permission. Even if she did give them permission, I should've been notified about it. I'm E-mailing the people at the Luckypup Ranch Puppy Store and telling them they don't have my permission to use the picture and should remove it. Quote
Guest Anonymous Posted June 10, 2003 Posted June 10, 2003 I just called the Luckypup Ranch Puppy Store even thought it's 5 AM CST and left a message detailing the situation and asking that they remove the picture promptly! I also closed the voice mail by asking them to reply to the matter at hand via by phone or E-mail (whichever is best for them) just as long as they get back with me. I also E-mailed the webmaster over at Dog Breed Info. Center and explained the situation to the webmaster. I asked her to incorporate a no right click code into ever page of the DBI site as to prevent people from stealing graphics and pictures that aren't theirs. I'm hoping that she'll take my advice and incorpate the no right click code. I'm really hoping I don't have to take legal action against the BYBs though if I have to, I will. I suspect they'll comply as to not draw to much attention to themselves being that BYBs aren't quite frowned upon in today's society. Quote

Guest Anonymous Posted June 10, 2003 Posted June 10, 2003 Ms. McGuire, the lady who runs DBI, E-mailed me back stating that she called the BYB people asking them to remove my photo and will keep calling until it's removed. She urged me to do the same. I just got off the phone and got a voice mail again for the BYB people. GRRRRR!!!! I was also told by Ms. McGuire that the no right click code was a great idea and she'd inform the tech guys about the it. She thanked me for the code. I'm so outraged that a BYB would swipe my dogs' picture from a good dog site and use it for their site to promote something I don't like nor advocate. Quote

She already added it to the 'about' page (http://www.dogbreedinfo.com/about.htm). ...12 hours passed and I didn't hear back anything from the lady that runs the Luckypup Ranch Puppy Store so I decided to call her again. I got a voice mail just like before. I left her another message. Ms. McGuire has been trying to reach her via E-mail and phone throughout the day and has also been unsuccessful in her efforts to reach Dr. Leah Garcia. I've contacted Charlie Crist the FL Attorney General and have filed a fraud complaint against Mrs. Garcia and Luckypup Ranch Puppy Store. I've also went ahead and filed a complaint with the FL Dept. of Agriculture's Division of Consumer Services. I'm REALLY upset over this and feel like I have every right to be upset. Quote
courtnek Posted June 11, 2003 Posted June 11, 2003 I may be wrong, but I dont believe a copyright is necessary in the case of personal photo's...copyrights are used to protect inventions from being stolen from the inventor and such....If this person cannot prove the photo was given to him willingly, then it's theft... there are ways to change a photo to look "different" from the original, but since it was recognized those ways were not used. I would slam them. They are trying to make money from yur photo - make them pay YOU.... Quote

I checkd Earthlink's Policies & Agreements section. Dr. Garcia is in violation of Earthink's Terms & Conditions. Furthermore, she is in direct violation of the Digital Millennium Copyright Act . I have E-mailed the Earthlink abuse team and carbon copied an E-mail to Ms. McGuire. We also learned that Dr. Garcia has stolen textual information from DBI in addition to the dog pictures. What Dr. Garcia has done is totally unacceptable and she should suffer some ramifications as a result even if it means having Earthlink terminate her account. Hopefully, Dr. Garcia won't try to get out of it by saying, "I had know idea what my site webmaster was doing until now" because that's just pure BS! and a lack of professionality on her part. She should know what her people are doing. After all, she's doing the hiring and paying their salaries. Courtnek, I see you're in Elgin, IL. That's not that far from me. Maybe we could get together sometime for a weekday lunch or weekend shopping spree. Quote

However, the text remains. The ***hole that manages the Luckypup Ranch Puppy store website has now resorted to slander/libel, take a look: http://www.gate.net/~luckypup/keeshond.html I have contacted Ms. McGuire to let her know that he's now resorted to slandering me. I'm even more upset that the guy would be this low. I contacted the Lake County Bar Association who recommended a lawyer that handles slander suits. I've given the Luckypup Ranch people 24 hours to remove my picture and stop the slander otherwise they shall face a civil lawsuit. Their dogs are the result of bad breeding, not mine! Quote

Please get help somewhere!" is just really low!! I have an idea that might proove that the picture is yours. Do you have the negative of the picutre and the original picture? If so, you have an even better chanse of a lawsuit. I'd been given the link to a new "rescue" that had a lot of greyhounds and lurchers needing homes, and been asked to crosspost their details to our site. I was looking at the site and saw a really lovely looking dog on it, and was showing my friend through MSN messenger. I told her to look at the cute dog I'd seen, and she got the shock of her life! The dog under the one I was showing her on the page was her dog - marked up as a female needing a home. They had pinched the picture (dont know if it was the first time or not) off our site, and used it to advertise their dogs. Turns out they're not the most reputable of rescues, and were also "selling" dogs through the free-ads, and also race dogs - so the greys they had needing homes might have been their own. I wont name the rescue, as this could still be a misunderstanding, but as we've had no reply to the emails sent, we're assuming they dont want to explain it. They've removed the pic now, but no apology as yet that I know of. :( :-? Quote

She has asked you many times to remove it, but you have only replied by saying that her picture is a picture of illbred dogs.
